King & Spalding lost two major clients over their decision to drop the DOMA case, the state of Virginia and the National Rifle Association. However, in addition to protests from LGBT civil rights organizations, King & Spalding also was asked to drop the case by its client CocaCola, according to sources close to the firm. Other clients also expressed their opposition to the firm's defense of DOMA.

"For many gay rights advocates, the decision amounts to a turning point in the debate," noted Adam Liptak of the New York Times, "the moment at which opposition to same-sex marriage came to look like bigotry, similar to racial discrimination and the subordination of women."

Five charged with beating gay man

Rock Hill, S.C.-Five men have been charged with the April 9 beating of a gay man outside of a convenience store, facing maximum sentences of 20 years in prison.

Four of the five have criminal records starting in their teen years, and each faces charges of assault and battery of a high and aggravated nature. As of April 29, they were all still being held on $5,000 bond in York County Jail.

They are accused of beating 19-year-old Joshua Esskew, who they allegedly taunted before he was hit in the head by a beer bottle. The assault was captured on the store's video surveillance cameras.

York County Sheriff Bruce Bryant said that race and sexual orientation were irrelevant to police handling of the case; while Esskew is white and his assailants are black, South Carolina has no gay-inclusive hate crime law, although a bill has been introduced in the wake of the attack.

The men who were charged are Bobby Wilson, 30, Cortezio Laquise Douglas, 21, Lajames Mitchell, 22, Darenco Markie Wilmore, 21, and Lortarius Duncan, 22.

The FBI is still investigating the beating under the auspices of the Matthew Shepard/ James Byrd Jr. Hate Crime Prevention Act, which allows federal investigators to step in when local authorities are unable or unwilling to investigate what is believed to be a hate crime.

Labor Dept. adds gender ID to job rules

Washington, D.C.-The Department of Labor announced on April 28 that it was adding gender identity to its equal employment policies, which apply to hiring, promotion and disciplinary practices.

The changes also include adding pregnancy status to the equal employment statement.

"The Department of Labor's announcement makes it clear that it is a place that values diversity and allows people to contribute their talents and skills free from discrimination," Carey continued.

The NGLTF led a coalition of 26 organization under the banner New Beginning Initiative, which advocates for LGBT-friendly federal policies.

Tenn. bill would void city rights laws

Nashville, Tenn.-The Tennessee House of Representatives approved a bill at the end of April that would undo Nashville's LGBT-inclusive equality ordinance.

While supporters of the bill claim that it is solely designed to standardized rules for contractors seeking to work for municipal governments across the state, the Equal Access to Intrastate Commerce Act specifies that no municipality or county can extend antidiscrimination protections beyond what it offered by state law.

Tennessee law does not protect against discrimination by sexual orientation or gender identity, and, adding insult to injury, the bill specifies, "Sex' means and refers only to the designation of an individual person as male or female as indicated on the individual's birth certificate."

The House voted 73-24 in favor of the bill on

April 25.

"We want to say that it's okay to discriminate on sexual identification and gender," State Rep. Jeanne Richardson said, according to the Nashville Tennessean. "Everybody sitting in this room knows what this bill is about."

In addition to Richardson, it also drew the ire of other legislators, who argue that it is a strict violation of the idea of small government and violates the will of the people of Nashville.

"You're telling them that, basically, they have to discriminate against people," Rep. Sherry Jones said. "You're trying to go back and retroactively change the law that my city has determined is good for them."
